Terms and Conditions

By booking any tour on the Kosher Cycle Tours website, owned and operated by Aaron Hurwitz (hereinafter: “KCT”), tour participants confirm that they have read these Terms and Conditions carefully, and in their entirety, and as a result have a complete understanding of their rights and obligations as KCT customers, as well as of KCT’s rights and obligations to the participants. A customer must agree to these Terms & Conditions in order to book a KCT tour. Unless explicitly stated otherwise, these Terms and Conditions supersede and replace any other commitments, undertakings or representations made, or given by, or on behalf of KCT, and participants confirm that they have not relied on any statement, promise or representation made or given by, or on behalf of KCT which is not explicitly specified in these Terms and Conditions. All KCT tours are subject to the following Terms and Conditions:

Reservations and Deposits

All reservations must be accompanied by per-participant deposits of USD $1,000 per tour (or the equivalent thereof in ILS). A reservation will not be deemed final until this deposit has been received by KCT.

Payment Methods

KCT accepts payment by:

  • Zelle: USA customers can use Zelle to transfer USD to [email protected].
  • Israeli bank transfers – העברה בנקאית: Israeli customers can transfer Israeli Shekels to KCT’s bank account. Contact [email protected] for bank account information.
  • Wire transfers: Customers can wire payments to KCT’s USA or Israel bank accounts. All wire expenses are the sole responsibility of the customer. Contact [email protected] for details.
  • USD check: Please make the check payable to Aaron Hurwitz. Contact [email protected] for the mailing address. The amount shall not be deemed as having been paid until the check has cleared.
  • Israeli Shekel check: Please make the check payable to Aaron Hurwitz (or אהרן הורוויץ in Hebrew). Contact [email protected] for the mailing address. The amount shall not be deemed as having been paid until the check has cleared.
  • Cash: Payments in cash may be made up to the value of ₪11,000. See currency conversion rates here.

Reservation Cancellation Policy

Below please find the KCT reservation cancellation policy. Cancellation requests must be submitted in writing to [email protected]. Refund of any deposit, if warranted, will be issued within 10 business days after KCT receives the cancellation request, in accordance with the following:

When Request is Made Refund Policy
Within the first 24 hours of making the reservation, regardless of when the reservation is made: Customers will receive a full refund minus any fees or expenses incurred by KCT.
91 days or more prior to departure: Customers will receive 50% of their deposit, minus any fees or expenses incurred by KCT.
61 - 90 days prior to departure: Customers will receive 25% of their deposit, minus any fees or expenses incurred by KCT.
60 days or less prior to departure: No refund of any deposit will be made.

Payment of Balance

The balance of the payment is due 90 days prior to the tour departure date. If a reservation is made within 90 days prior to the tour departure date, the customer must pay the balance within 5 business days from the date on which the tour is reserved. If no payment is received by KCT by the above deadlines, KCT will deem the same as cancellation of the reservation, and the reservation cancellation policy will apply.

Cancellation After Payment of Balance

If, for whatever reason, a customer decides to cancel his/her tour after having paid the balance due for the tour, the cancellation must be in writing to [email protected] and, insofar as warranted, refunds will be issued within 10 business days in accordance with the following:

91 days or more prior to departure:Customers will receive 100% of the balance (plus 50% of their deposit, as specified above in the reservation cancellation policy), minus any fees or expenses incurred by KCT.
61 – 90 days prior to departure:Customers will receive 50% of the balance (plus 25% of their deposit, as specified above in the reservation cancellation policy) minus any fees or expenses incurred by KCT.
60 days or less prior to departure:No refund will be made of any amount paid by customers to KCT in respect of the tour.

Transferring Tours to Replacement Participants

Bookings are fully transferable to another person at no additional cost, provided that the person replacing the original customer is eligible to participate in a KCT tour.

KCT requires a minimum of 30 days notice prior to the start of the tour to allow for the necessary adjustments to be made. Israel VAT charges will apply if the person replacing the original customer is liable for VAT. Note that KCT may not be able to accommodate transfer requests made less than 30 days in advance of a tour. Please contact KCT at [email protected] to arrange details.

Modification of booking

If a customer wishes to change any details of the tour after a reservation has been confirmed, s/he must  contact KCT in writing via email at [email protected] and KCT will do its best to facilitate such changes, but KCT does not commit to, and will not be  liable for the refund of any amounts following such changes.

If a customer wishes to change tours and participate in a different tour offered by KCT, s/he must  contact KCT in writing at [email protected] and, depending on availability, KCT will try to  facilitate the change. In such a case, additional payment for a more expensive tour may be required, but KCT neither commits to, nor is liable for the refund of any amounts following  a change.

If a customer decides to change or cancel any details of a tour after the tour has begun, s/he will be liable for any additional costs, and there will be no refund for any unused elements of the tour.

Minimum Participation

KCT requires at least 6 participants to run any of its tours for the advertised prices. In some cases, KCT may be able to run a tour with fewer participants. If there are fewer than 7 participants, KCT may send only one KCT staff member with the group. Participants  will be advised of this prior to departure.

 

Cancellation of a Tour by KCT

KCT reserves the right to cancel any tour, at its sole discretion, including if there are too few participants, or if, for whatever reason, the quality of the tour or the safety of the tour participants may be compromised. In the event of cancellation of a tour by KCT, customers will be informed no later than 30 days prior to the start of the tour.

If a tour is cancelled, KCT will do its best to offer a suitable alternative tour, and, if this is not acceptable to the customer, s/he will be entitled to a full refund of any payment s/he made to KCT in respect of such tour, within 10 business days after KCT receives the customer’s request for a refund. The above will constitute full settlement in respect of cancellation of the tour as aforesaid, and the customer will not be entitled to any other or additional amounts from KCT, including, inter alia, in respect of any loss and/or expense incurred due to non-refundable or non-transferable air tickets or other unrecoverable travel costs. KCT shall bear no liability for any cost and/or damage and/or loss and/or expense incurred by customers as a result of cancellation of any tour by KCT as aforesaid over and above liability for the refund of the full amount paid by the customer to KCT for such tour until the date of the cancellation.

 

Changes to Tours

KCT reserves the right to make changes to accommodations and routes, insofar as such changes become necessary or advisable due to circumstances beyond its control and/or for the comfort and/or wellbeing of the tour participants, at its sole discretion, and in the event of such changes the tour participants shall not be entitled to any compensation or reimbursement or payment from KCT. In the event of a change of accommodations, KCT will do its best to book alternative accommodations at a standard equal to the standard originally advertised. KCT undertakes to inform participants of such changes as soon as possible.

Transportation to and from Tours

Each tour will begin at a time and meeting place specified by KCT in the tour description. Participants will be responsible for providing their own transportation to the meeting place, and for being there on time. At the end of each tour, KCT will provide group ground transportation to the drop-off location specified by KCT in the tour description.

The cost of a KCT tour does not include transportation to the meeting place at the start of the tour, nor return transportation from the drop-off location at the end of the tour. Each participant is responsible for booking his or her own travel, including flights if needed, to the meeting place and from the drop-off location. Please contact KCT before booking travel arrangements to ensure that the dates and times are compatible with the tour plans. KCT can recommend a travel agency if needed.

If a participant wishes to arrive earlier or stay on after a tour, please notify KCT to coordinate. Any additional hotels stays and transportation needs, outside of the tour dates, shall be arranged by participants directly with the providers of such services of their choice.

 

Passports & Visas

All KCT tour participants must have a valid passport that is valid for 6 months after the date of the return flight. It is the tour participants’ responsibility to ensure that they have a valid passport, and visa if necessary, and any other documentation that is required. Since entry requirements vary from country to country, and depend on the country of origin, each participant must ensure that s/he has the appropriate travel documents for the country/countries in which KCT participants will be riding on the tour. A participant’s specific passport and visa requirements and other immigration requirements are his/her sole responsibility, and s/he should confirm these with the relevant Embassies and/or Consulates. While US citizens generally do not need a travel visa, US citizens can view a traveler’s checklist for US passport holders here.

KCT assumes no responsibility for changes in travel document requirements, nor for carriage or entry into any destination for any tour participant. KCT bears no responsibility for any participant’s inability to travel due to failure to comply with any passport, visa or immigration requirements. KCT is not liable for any costs and/or expenses and/or losses incurred by participants due to their being denied entry into any country during the tour. Participants who are denied boarding or entry will receive no refund.

 

Transportation During Tours

KCT provides group ground transportation from the meeting place on the first day of each tour, and to the drop-off location on the last day of each tour, unless stated otherwise in the tour description. Tour participants who arrive or depart on a day other than the first and last days of the tour shall coordinate with KCT directly in writing via email ([email protected]) regarding meeting places and times.

Land transportation during the tour will be as specified in the itinerary. Vehicles suited to the size of the group will be used, including minibuses, midibuses, tour buses, vans, private limousines, taxis, rental cars or trains.

Neither KCT nor the founder, employees thereof or agents thereof shall be liable for any bodily injury and/or property damage and/or expense and/or cost and/or loss that shall be caused to any customer as a result of an act and/or omission of the providers of ground transportation services and/or employees and/or agents thereof in respect of any tour.

Hotels and Accommodations

Information regarding the accommodations for a tour can be found in the description of that tour.

Generally, and unless stated otherwise in the tour description, the basic tour price stated is based on a standard room, double occupancy in twin or double rooms. If a participant prefers a single occupancy and/or upgraded room, s/he shall contact KCT in writing via email ([email protected]) at least 30 days before the tour.  This change will entail additional charges and will depend on availability.

If a participant is traveling alone and wishes to share a room, KCT will endeavor to pair him or her with a roommate of the same biological sex. If KCT is unable to find a suitable roommate, the additional single occupancy surcharge may apply.

Neither KCT nor the founder, employees thereof or agents thereof shall be liable for any bodily injury and/or property damage and/or property theft and/or expense and/or cost and/or loss that shall be caused to any participant by an act and/or omission of the providers of accommodation services (including hotels, chalets, and AirBNB accommodations) and/or employees and/or agents thereof in respect of any tour.

During certain tours, participants will stay in chalets or AirBNB accommodations. Chalets and AirBNB accommodations are sometimes configured with 3 or 4 people per bedroom. If a participant is  staying in a chalet(s) or AirBNB Accommodation(s) during a tour, s/he may be accommodated in a room with more than one roommate

Please inquire with KCT for specific information on accommodation prior to booking.

Meals

During its tours, KCT will arrange for tour participants to be provided with 3 meals a day, unless otherwise stated in the tour description. Meals will be provided, inter alia, at hotels, restaurants, etc. or will be BBQs or picnics.

Neither KCT nor the founder, employees thereof or agents thereof shall be liable for any bodily injury and/or illness and/or distress and/or expense and/or cost and/or loss that shall be caused to any participant as a result of an act and/or omission of the providers of food services (including hotels, caterers and restaurants) and/or employees and/or agents thereof in respect of any tour.

Food served on KCT tours may contain dairy, nuts, and other foods that may trigger an allergic reaction. Tour participants must notify KCT of any food allergies. While KCT will do its best to accommodate participants who suffer from food allergies, tour participants waive any and all claims against KCT, its founder, employees, agents, subcontractors, and any other persons and entities involved in the tour, in respect of any damage and/or harm and/or illness and/or distress and/or cost and/or expense and/or loss suffered by a tour participant relating to food allergies.

Kashrus

KCT provides kosher food of a mehadrin standard, except when explicitly stated otherwise. KCT defines mehadrin as follows:

In Israel: Meat products that are under the following hechsherim:  Eidah Chareidis, Rabbi Landa, Rabbi Rubin, Beit Yosef, Rabbi Machfud, OU, and OK. Dairy products that are cholov yisroel products under the following hechsherim:  Eidah Chareidis, Rabbi Landa, Rabbi Rubin, Agudas Yisroel, Beit Yosef, Mehadrin Rav Weitman – Tnuva, Rabbanut Mehadrin, OU cholov Yisroel, and OK. Pareve foods that are under the following hechsherim: Eidah Chareidis, Rabbi Landa, Rabbi Rubin, Beit Yosef, Agudas Yisroel, Rabbi Machfud, Rav Efrati, Rabbanut Mehadrin, Machzikei Hadas (Belz), Chug Chasam Sofer – Bnei Brak and Petach Tikvah, OU, and OK

In addition to the hechsherim mentioned above, KCT may provide meals at establishments that are under the following hechsherim: Rabbanut Mehadrin Yerushalayim, Tel Aviv Rabbanut Mehadrin, Rabanut Emek HaMayanot Mehadrin, and Rabbanut Mehadrin Eilat.

In Europe: When KCT tour participants are due to stay at a kosher hotel or program, KCT will inform customers of the standard of the hechsher as advertised by the hotel or program. If KCT provides tour participants with food from another caterer or establishment, the food will be certified glatt kosher and/or cholov yisroel. If a KCT chef is cooking the food, KCT will source mehadrin food with guidance from The Rabbinical Centre of Europe (RCE) and the chef will be frum or supervised by a mashgiach kashrut.

Nutrition on Rides

Nutrition and sports drinks on rides will include sports drink powder, Nature Valley bars, Larabars, pretzels, gels, fruit and candies. KCT provides sports nutrition with an Israeli mehadrin hechsher, OU, OK, Triangle K, Chof K, London Beit Din or the Rabbinical Centre of Europe.

Minyanim

When staying at a hotel with a shul, KCT will plan its itinerary to daven with the hotel minyan or will make its own minyan at a time compatible with the tour. When the tour is on the road with no option to daven in a shul, KCT will plan for participants to daven on the road. If a tour is in a location with no shul, tour participants will daven in a makeshift shul in the hotel or chalet. KCT will do its utmost to have a Sefer Torah on the tour.

Shabbos

KCT is fully shomer Shabbos.

Riding Competency

KCT understands that riders have different abilities and will do its best to allow participants to ride at a speed with which they are comfortable. However, it is clarified that riders who are far behind the rest of the group may be collected by the support vehicle and brought to join the rest of the group.

Group Composition

KCT cannot guarantee the composition of the group, nor does it profile, in terms of nationality, ethnicity, sex, or marital status. Minimum age for participation is 18 years old.

Bicycles

Tour participants are required to have the proper bicycle and cycling equipment needed for the selected tour. KCT strongly recommends the use of a multi-speed road bicycle for its tours. Many cyclists prefer to use their own bicycles for assured comfort and better tour enjoyment.

KCT may be able to provide customers with details of companies that rent out bicycles at the location of the tour. Participants who rent bicycles bear full and sole responsibility for any and all damage to and/or theft of the rented bicycle.

KCT will arrange for a mechanic to be available at the start of the tour to help ensure that participants’ bicycles are tuned and ready to ride (basic tuning). KCT does not commit to provide bicycle maintenance over and above basic tuning and adjustments at the beginning of the tour, and participants assume full responsibility for their equipment being in suitable condition and roadworthy for participation in a tour. Participants bear full and sole responsibility for maintenance of their bicycle throughout the duration of the tour. KCT cannot guarantee that compatible tools and/or spare parts will be available to repair or replace damaged bicycles, given the wide range of bike makes and models, equipment and parts needed.

Neither KCT nor the founder, employees thereof or agents thereof shall be liable for any damage and/or theft and/or loss that shall be caused to any bicycle (whether the participant’s own or rented) on any KCT tour.

Neither KCT nor the founder, employees thereof or agents thereof shall be liable for any bodily injury and/or property damage and/or distress and/or death and/or harm and/or expense and/or cost and/or loss to any participant that shall result from equipment malfunction.

Helmet Use

All participants must wear properly fitting bicycle helmets that comply with international standards.

Clothing for Tours

KCT provides general guidelines on clothing, gear and equipment for each tour based on weather forecasts. These guidelines constitute general suggestions only and shall not be relied on as a definitive list. KCT shall bear no responsibility for any discomfort and/or cost and/or expense caused as a result of reliance on the above guidelines.

Kosher Cycle Tours Jerseys

KCT offers each tour participant one KCT short sleeved jersey (included in the price of the tour). Each participant shall inform KCT of his/her size, based on the size chart provided on www.koshercycletours.com. Where more than one style is offered, the customer shall inform KCT of the style s/he prefers. KCT will endeavor to ensure that the jersey arrives before the tour, but does not commit to its timely arrival. In the event that the jersey is not available prior to the tour, KCT will send the jersey to the participant’s home by post upon availability.

Preparedness, Safety, Fitness, and Inherent Risks

KCT does not provide any instruction with regard to bicycle use. Participants affirm that they are familiar with the operation of a multi-speed bicycle, and are familiar with the rules of the road for bicyclists. Participants commit to respecting all safe cycling rules and undertake to comply with local road traffic laws and any directions that may be given by KCT staff. Tour participants undertake to cycle in a manner that shall in no way cause damage, distress, danger or annoyance to other road users including fellow cyclists and/or any third party, and/or damage to any property.

Tour participants confirm that they have the bicycle handling and riding skills necessary to participate in the tour they have chosen. Neither KCT nor the founder, employees thereof or agents thereof shall be liable for any bodily injury and/or illness and/or distress and/or death and/or property damage and/or harm and/or expense and/or cost and/or loss caused to any participant or to any third party by any participant as a result of poor bicycle riding and/or poor bicycle handling skills and/or inadequate training, abilities, fitness level, or preparation for a tour.

KCT tours are physically demanding and strenuous. KCT provides information on the distance and vertical gain of each tour in its tour materials and website descriptions.  The distances and elevation gains advertised by KCT are based on maps by Ride With GPS https://ridewithgps.com. Actual distances and elevation gains on the tours may be different from those advertised by KCT. KCT bears no responsibility for any differences between the advertised distances and elevation gains and the actual distances and elevation gains.

Tour participants confirm that they understand the physical and other requirements of the tours that they choose, and undertake to select a tour that suits their interests, abilities and fitness level.

Tour participants confirm that they understand that riding a bicycle involves certain inherent risks, including bodily injuries, property damage, other harm and even death. There is a risk, inter alia, of falling from a bicycle, crashing a bicycle, including crashing into stationary or moving objects, including cars and other vehicles, or being crashed into by another road user. Crashes may result, inter alia, from road conditions, environmental conditions, equipment failure or improper usage, acts of other road users, distraction, and other reasons known and unknown. Tour participants confirm that they understand that KCT does not assume responsibility for these inherent risks which may cause unfortunate accidents or incidents.

Neither KCT nor the founder, employees thereof or agents thereof shall be liable for any bodily injury and/or death and/or property damage and/or harm and/or distress and/or expense and/or cost and/or loss that shall be caused to any participant or to any third party as a result of any accident or incident, regardless of the cause thereof, including due, in whole or in part, to negligence or other fault (but not willful or fraudulent conduct) of KCT.

Medical Care, Rescue and Emergency Care

All tour participants undertake to take out adequate medical travel insurance for the tour that they choose.

KCT bears no responsibility for providing tour participants with non-emergency and/or emergency medical care, nor for arranging for participants to receive non-emergency and/or emergency medical care, during or after the tour.

In addition, tour participants confirm that they understand that tour activities are often in rural, mountainous areas, and that medical services or facilities may not be readily available or accessible during some or even most of the portions of the tours.

If a situation arises in which a tour participant needs rescue services or emergency medical care, KCT will endeavor to call such rescue services or medical services at the earliest possible opportunity. Tour participants hereby consent to the calling of such rescue services or medical services, at KCT’s sole discretion, and tour participants also undertake to bear any and all costs and expenses relating to such rescue services and/or rescue attempts and/or medical transport and/or medical care and/or medical treatment and/or medical services, as deemed necessary by KCT staff and/or rescue services and/or medical services. Tour participants understand that rescue services and medical transport and treatment may be unavailable in certain areas, and where available may be unsuccessful, and expensive.

Neither KCT nor the founder, employees thereof or agents thereof shall be liable for any bodily injury and/or illness and/or distress and/or death and/or expense and/or cost and/or loss that shall be caused to any participant or to any third party as a result of lack of medical services or due to medical care and/or medical treatment and/or rescue attempts, including due, in whole or in part, to negligence or other fault (but not willful or fraudulent conduct) of KCT.

It is clarified that KCT bears no liability for any costs and/or expenses of any rescue service and/or medical transport and/or treatment and/or care that a tour participant may require while participating in a tour thereof, nor does KCT bear any responsibility for the quality of such medical care, or lack thereof.

Health

By booking a KCT tour, tour participants confirm that they are in a physical, mental, and emotional condition to perform the activities of the chosen tour. Tour participants declare that they are not aware of, nor under treatment for any illness or ailment or injury that may potentially adversely affect participation in a cycling tour. If there is any doubt about a tour participant’s fitness or ability to participate in the chosen cycling tour, the participant shall consult his/her doctor or medical practitioner.

KCT must be advised in writing, upon or prior to booking, of any physical, emotional or mental condition that may require professional attention during the tour. If any such condition is diagnosed after the tour is booked, participants must immediately notify KCT thereof in writing via email ([email protected]). If a participant brings medicine or medical equipment on a tour, s/he will be fully responsible therefor.

KCT, at its sole discretion, reserves the right to discontinue a participant’s participation in a tour if the participant acts in a way that KCT deems, at its sole discretion, to be harmful to others or to himself/herself, or, if through inappropriate behavior, the participant is adversely affecting the enjoyment of other participants, without KCT being liable for refunding to such participant any amount. In such a case, the cost of the remainder of the tour will be forfeited by the participant, and KCT shall bear no liability, financial or otherwise.

Participants who generally wear corrective eyeglasses or lenses shall wear the same during any KCT cycling activity.

Insurance

Participants shall take out an appropriate comprehensive travel and medical insurance policy to cover all aspects of the chosen road cycling tour, including loss of deposit and full payment due to tour cancellation or interruption, loss of luggage and personal items, damage or loss to a privately owned or rental bicycle, overseas medical, dental, hospital, and emergency expenses, medical evacuation, including to participant’s country of origin, accidental death and transport of a dead body to the country of burial, and legal third party liability. Such insurance is NOT included in the tour price, nor is it offered by KCT.

Smoking

KCT has a no-smoking policy inside the accommodations where participants stay, and in all KCT vehicles. If participants wish to smoke they may do so outside, while being considerate of others.

Force Majeure

KCT bears no liability whatsoever, and will pay no compensation or refund in respect of any injury, damage, loss, delay, additional expenses or inconvenience caused, directly or indirectly, as a consequence of ‘force majeure’.

In these Terms and Conditions, ‘force majeure’ means any event which neither KCT nor employees or agents on behalf thereof could, even with due care, foresee or avoid. Such events may include, but are not limited to, changes due to war, acts of Government or of any other authorities, threat of war, acts of terrorism, threat of terrorism, riots, civil strife, strikes and/or industrial disputes, accident to or failure of machinery or equipment, natural or nuclear disasters, adverse weather conditions including but not limited to heavy rain, landslides, floods, and high winds, fire or threat of fire, or other acts of God that are beyond the control of humans.

Since the riding on KCT tours is outdoors, it is subject to weather conditions at the time of the activity. Tour participants commit to pack each day so as to be prepared for all types of riding conditions. If the group rides in inclement weather, and participants do not wish to cycle, the said participants may get a lift in the Support and Gear vehicle. Heavy rain, and rain combined with cold weather (5° C and below) and/or high winds can cause dangerous riding conditions. In such conditions, KCT may choose, at its sole discretion, not to ride, and this may mean that the tour will omit part of the scheduled itinerary. KCT reserves the right to change itineraries or tour arrangements if KCT deems that weather conditions may endanger the safety of its customers. KCT does not provide any refunds, discounts, or compensation due to changes in itineraries or tour arrangements as a result of inclement weather.

Privacy policy

KCT will keep all customer details confidential. Tour participants agree that any photographs or videos taken by or on behalf of KCT are the property of KCT and KCT may make any use thereof as it deems fit.
